Choice Policies

TERMS:
2% - 10 Days - Net, 30 days from date of invoice.  A service charge of 1.5% per month will be added to any overdue account.

PRICES:
Are F.O.B. our plant, Denver, Colorado, unless specified

DROP SHIPMENTS:
All drop shipments to DISTRIBUTOR'S customers will be sent showing Distributor as the shipper.  Shipments will be sent prepaid with the freight bills sent to the Distributor, unless otherwise specified.

MINIMUM ORDER:
Minimum order is $50.00.  A handling fee of $7.50 will be assessed for orders less than $50.00.  NO PRODUCTS WILL BE SOLD IN LESS THAN CASE LOTS.

DELIVERY:
Orders of $150.00 or more will be delivered to Distributors's warehouse free of charge (Denver Metro area only).  Orders less than $150.00 or out of Denver Metro area will be delivered to Distributor's warehouse with a zone delivery charge added.  Drop shipments to Distributor's customers will be charged with a zone delivery rate.  Zone charges can be checked at the time of order.  All other orders will be F.O.B. at our plant.

LABELS:
All products are labeled in accordance with regulations of the EPA, USDA, under Federal Hazardous Substance Act, and other applicable laws and regulations.  We offer an attractive paper label which can be custom imprinted with your logo, name, address, and phone number at the following rates:
Your Logo added to label (one time charge) $60.00
Name, address, phone number added to logo (one time charge) $35.00
Private labels can be designed from your copy or ours, and printed at your cost.  Artwork, typesetting, and plate charges are billed at a flat rate of $40.00 per hour.  Check with us for further details.  If you prepare your own private labels, please comply to all labeling laws.  We will attach your label at no additional charge.

POLICY REGARDING RETURNS:
No returns are accepted without our prior written permission via telephone or mail.  Authorized returns (in unopened containers) for reasons other than defective material, will be credited at invoice price.  All products which have been opened, will be credited only after the product is verified to be defective.  The cost of assaying to verify that returned EPA products meet specifications will be deducted from customary credit allowed.  ALL RETURNS MUST BE ON A PREPAID FREIGHT BASIS.

WARRANTIES AND DISCLAIMERS
Choice Manufacturing Company warrants that all shipments conform to products that have been approved, tested and accepted by your company.  Choice Manufacturing Company makes no warranties beyond these warranties and it is expressly the duty of your company to inspect all shipments of goods from Choice Manufacturing Company, by statistical sampling and/or performance testing prior to any sale of such goods by your company.  Your company shall have the responsibility for performing all such tests or sampling, otherwise inspecting, and rejecting, or revoking acceptance, within 30 days from receipt of any particular shipment from Choice Manufacturing Company.  No shipment may be rejected and in no event may acceptance be revoked at a time later than 30 days after the receipt of shipment by your company.  Should any shipment of Choice Manufacturing Company fail to conform to the samples, in accordance with the warranties set forth above, and if your company then makes a rejection or revokes acceptance of said goods within a 30 day period set forth above, Choice Manufacturing Company shall replace, free of charge, the defective goods or refund the purchase price paid therefore, at the sole option of Choice Manufacturing Company.  Choice Manufacturing Company's liability is specifically limited to replacement or refund.  In no event will Choice Manufacturing Company be liable for any consequential damages sustained by your company or purchases of products from your company.

MATERIAL SAFETY DATA:
As you are probably aware, the new OSHA Hazard Communications Standard (found in Title 20, Code of Federal Regulations, sections 1900.1200) took effect November 25, 1985.  This standard and the various state and community worker Right-To-Know laws specify that information on toxic and/or hazardous substances be given to those who may possibly encounter such substances in the workplace.  One way of getting this information across is with Material Safety Data Shete (MSDS).  Therefore, in compliance with these regulations, Choice Manufacturing Company will be sending MSDS(s) to you for the product(s) you purchase from us.  It is your responsibility to pass copies of this information along to yoru customers.
